Terms of Service
1. Acceptance of Terms
By accessing the Site, submitting any form, downloading materials, or otherwise interacting with the Site or our Services, you accept and agree to these Terms and our Privacy Policy. This creates a binding agreement between you and Horizon Real Estate Group, LLC.
2. Definitions
- Site: pittcountybuyersbrief.com and all subpages, content, and features.
- Services: informational content, downloadable materials including the Pitt County Buyer's Brief and Market Activity Report, scheduling tools, contact forms, and related functionality.
- User / you: any individual or entity accessing the Site.
- Content: all text, images, data, market reports, graphics, logos, design, and other materials published on the Site.
- Company / we: Horizon Real Estate Group, LLC, a North Carolina limited liability company.
3. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts under North Carolina law. By using the Site, you represent that you meet these requirements.
4. Nature of Services; No Agency Relationship
The Site provides general informational content about real estate in Pitt County and Northeastern North Carolina. Site access, form submission, material downloads, or service use does not create an agency, fiduciary, brokerage, or representation relationship between you and Horizon Real Estate Group, LLC, Travis Old, or any affiliated party.
Agency relationships form only through written Agency Agreements complying with North Carolina General Statutes Chapter 93A and Real Estate Commission Rules. Prior to written Agency Agreement execution, any information you submit through the Site is general, non-confidential communication and may be used by us for marketing, lead qualification, and business development purposes.
5. Not Legal, Financial, Tax, or Investment Advice
Content on the Site — including but not limited to the Buyer's Brief, the Market Activity Report, chapter materials, market statistics, and all written analysis — is provided for informational purposes only. This content does not constitute legal, financial, tax, insurance, engineering, surveying, or investment advice.
You bear sole responsibility for independently verifying all information before acting. You should consult with licensed attorneys, CPAs, lenders, inspectors, surveyors, insurance professionals, and other qualified experts before making any real estate purchase, sale, or investment decision.
All estimates, data, and regulatory references are believed to be accurate as of the date of publication but are subject to change without notice.
6. Real Estate Disclosures
Horizon Real Estate Group, LLC holds a North Carolina real estate brokerage license. Travis Old is a licensed North Carolina real estate broker.
Equal Housing Opportunity. We support and comply with the federal Fair Housing Act and all applicable state and local fair housing laws.
Working With Real Estate Agents Disclosure. North Carolina law requires real estate brokers to provide the Working With Real Estate Agents Disclosure at first substantial contact.
Listings and Availability. All property listings, prices, availability, and terms referenced on the Site are subject to change, prior sale, or withdrawal without notice. Listings from third-party data sources including MLS are subject to Section 11.
7. Intellectual Property
All Content on the Site — including the Buyer's Brief, Market Activity Report, written copy, photography, graphics, brand elements, the Horizon Realty Group name and logo, and the structure and organization of the Site — is owned by Horizon Real Estate Group, LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use in connection with your own potential real estate transaction. This license forbids commercial use, reproduction, distribution, or derivative use of the Content.
Content use exceeding this license scope — including but not limited to the prohibited uses in Section 8 — constitutes material breach and may trigger civil and criminal liability.
8. User Conduct; Prohibited Uses
You agree not to:
- Scrape, crawl, harvest, or use automated means (bots, scripts, spiders) to access, copy, or extract Content from the Site without our prior written consent.
- Reproduce, republish, distribute, sell, license, or commercially exploit any Content.
- Use the Site or any Content for competitive analysis, benchmarking, or market intelligence purposes by any competing real estate brokerage, agent, team, or affiliated service provider.
- Reverse engineer, disassemble, or attempt to derive the source code of any software used to operate the Site.
- Use MLS or other third-party data accessible through the Site for any purpose other than your personal, non-commercial review.
- Submit false, misleading, or fraudulent information through any form on the Site.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Transmit viruses, malware, or any other harmful code; interfere with the operation of the Site; or attempt to gain unauthorized access to any portion of the Site or its infrastructure.
- Use the Site to send spam, unsolicited commercial communications, or any communication that violates applicable law.
- Violate any applicable federal, state, or local law, regulation, or the rules of the North Carolina Real Estate Commission or the REALTOR® Code of Ethics.
We reserve the right to investigate and take appropriate legal action against any user who, in our sole discretion, violates this Section, including terminating access, pursuing damages, and reporting the user to law enforcement.
9. User Submissions
Any information, feedback, suggestions, or other materials you submit through the Site (collectively, "Submissions"), excluding personal information governed by our Privacy Policy, are non-confidential and non-proprietary. Upon submission, you grant Horizon Real Estate Group, LLC a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate such Submissions for any purpose.
Information submitted through contact forms, scheduling tools, or email is not confidential unless and until a written Agency Agreement is in place.
10. Third-Party Links and Services
The Site contains links to third-party websites and services, including but not limited to cal.com, government resources (USDA, HUD, NCHFA, NC SHPO), Google, and Meta (Facebook/Instagram). We do not control and are not responsible for the content, policies, or practices of any third-party site or service. Your use of any third-party site is governed by their respective terms and privacy policies.
11. MLS Data Disclaimer
Real estate market data referenced on the Site is sourced in part from Multiple Listing Services ("MLS") via a RESO Web API feed. Data is believed to be accurate but is not guaranteed. MLS data represents the copyrighted property of the cooperating MLS and its participants and is licensed for limited, non-commercial use by prospective buyers.
Market data may be delayed, incomplete, or superseded by more current information. You must independently verify all property facts, listings, pricing, and market statistics with a licensed real estate professional before acting.
12. AI-Generated Imagery
Some images on the Site — particularly illustrative or editorial images accompanying history and other informational content — are AI-generated rather than photographs. These images are used for editorial and illustrative purposes only and do not depict any specific real event, property, or person with photographic accuracy.
This is separate from real estate listing photographs, which are sourced from the MLS and provided by the listing agent (see Section 11). AI-generated imagery is never used for listing photos.

13. Disclaimers of Warranty
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT;
- WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
14. Limitation of Liability
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100.00) OR (B) THE AMOUNT YOU HAVE PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in such jurisdictions, our liability is limited to the fullest extent permitted by law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Horizon Real Estate Group, LLC, Travis Old, and their respective officers, managers, members, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of the Site or Services;
- Your violation of these Terms;
- Your violation of any applicable law or regulation;
- Your violation of any third-party right, including intellectual property or privacy rights.
16. Governing Law and Venue
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles. Subject to Section 17, any action not subject to arbitration shall be brought exclusively in the state courts of Currituck County, North Carolina, or in the United States District Court for the Eastern District of North Carolina, and you consent to the personal jurisdiction of those courts.
17. Binding Arbitration; Class Action Waiver
17.1 Agreement to Arbitrate
You and Horizon Real Estate Group, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services (each, a "Dispute") shall be resolved exclusively through final and binding arbitration, rather than in court, except as set forth in Section 17.5.
17.2 Informal Resolution
Before initiating arbitration, you agree to first notify us in writing at the address in Section 21 and allow thirty (30) days for informal resolution. We will do the same before initiating arbitration against you.
17.3 Arbitration Rules
Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. Proceedings will take place in Currituck County, North Carolina, or, at your election, by telephone or video conference. The arbitrator's decision is final and binding.
17.4 Class Action Waiver
17.5 Exceptions
Either party may bring an action in small claims court for claims within that court's jurisdiction, or seek injunctive or equitable relief in court for claims involving intellectual property, unauthorized access, or violations of Section 8 (Prohibited Uses).
17.6 Opt-Out
You may opt out of this arbitration agreement by sending written notice to the address in Section 21 within thirty (30) days of first using the Site. Your notice must include your full name, address, and a clear statement that you wish to opt out.
17.7 Severability
If the Class Action Waiver in Section 17.4 is found to be unenforceable as to any particular claim, that claim shall be severed and brought in court; the remainder of this Section 17 shall remain in effect.
18. Termination
We may suspend or terminate your access to the Site at any time, for any reason or no reason, without notice or liability. Upon termination, Sections 7, 8, 9, 13, 14, 15, 16, 17, and 20 survive.
19. Changes to These Terms
We may update these Terms at any time. Material changes will be indicated by updating the "Last Updated" date at the top and, where appropriate, by posting notice on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
20. General Provisions
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Horizon Real Estate Group, LLC regarding the Site and supersede all prior agreements.
No Waiver. Our failure to enforce any provision is not a waiver of that provision or any other right.
Assignment. You may not assign these Terms. We may assign these Terms at any time without notice.
No Third-Party Beneficiaries. These Terms do not create any third-party beneficiary rights, except that Travis Old and our affiliated agents are expressly intended beneficiaries of Sections 14 and 15.
Headings. Section headings are for convenience only and do not affect interpretation.

22. $250 Buyer's Brief Quiz Credit — Offer Terms
This offer is made available by Travis Old, a North Carolina licensed real estate broker (NC Real Estate Broker License #334264), through Horizon Real Estate Group, LLC, d/b/a Horizon Realty Group ("Horizon Realty Group," "we," or "us"), for the three Pitt County Buyer's Brief comprehension quizzes: the Greenville & the ECU Corridor Brief Quiz, the Farmville & Heritage Towns Brief Quiz, and the Rural Pitt Farmland Brief Quiz (collectively, the "Quizzes").
22.1 Eligibility
A visitor who completes any one of the three Quizzes with a passing score of 80% (10 of 12 questions) or better is issued a discount code, PITT250, identifying them as eligible for this offer.
22.2 The Credit
A visitor who passes a qualifying Quiz and subsequently retains Travis Old, individually, as their exclusive buyer's agent under a written buyer representation agreement, and completes a purchase of real property with Travis Old acting in that capacity, is entitled to a $250 credit applied toward Horizon Realty Group's agency services in connection with that purchase.
22.3 One Credit Per Household — Not Cumulative
This is a single, one-time credit of $250 per household, in total, across all three Quizzes. A household that passes more than one of the three Quizzes — two, or all three — remains entitled to only one $250 credit. Credits earned from separate quiz completions do not stack, combine, or otherwise aggregate to increase the value of the credit beyond $250 per household. This offer is not combinable with any other discount, promotion, rebate, or offer extended by Horizon Realty Group or Travis Old. This offer and its household credit pool are specific to pittcountybuyersbrief.com and are entirely separate from, and not combinable or cumulative with, any comparable quiz offer or discount code issued on any other Buyer's Brief site, each of which maintains its own independent offer and household credit pool.
22.4 No Cash Value
The $250 credit has no cash value and is not redeemable for cash, in whole or in part, under any circumstance. It has value only as a credit against Horizon Realty Group's agency services on a completed purchase transaction in which Travis Old serves as the buyer's exclusive agent.
22.5 How the Credit Is Applied
The specific manner in which the $250 credit is applied at closing — including whether it is reflected as a closing-cost credit, a commission adjustment, or another mechanism permitted under applicable law and lender guidelines — is determined solely by the closing attorney and/or the buyer's mortgage lender handling the transaction. Horizon Realty Group and Travis Old do not control, and cannot guarantee, the specific accounting mechanism by which the credit is reflected on the buyer's closing disclosure or settlement statement, and make no representation as to how any particular attorney or lender will apply it.
22.6 Conditions
This offer requires all of the following: (a) a passing score on at least one qualifying Quiz; (b) Travis Old acting as the buyer's exclusive buyer's agent under a written buyer representation agreement; and (c) a completed, closed purchase transaction. Passing a Quiz confers no right to representation by Travis Old, no guarantee of a completed transaction, and no value independent of a closed purchase in which Travis Old serves as the buyer's agent.
22.7 Verification and Changes
Horizon Realty Group may verify quiz completion and household eligibility against its own lead records before applying the credit. Horizon Realty Group reserves the right to modify, suspend, or discontinue this offer at any time without notice, except as to a buyer who has already qualified and is under contract on a purchase in progress at the time of any such change.
